BHdesign Terms of Services

(1) CONTRACTS OF AGREEMENT.

The contracts of agreement are legally binding terms governing the client/s use of BHdesign services. BHdesign encourages the client/s to read the contract of agreement carefully and not to use the services of BHdesign if you do not wish to be legally bound by the terms of services.

(2) SOFTWARE POLICY.

The client/s understand and comply with the software used to conduct BHdesign business transactions of communications, advertising, and payment. Houzz privacy policy (https://www.houzz.com/privacypolicy) extends to the IVY payment platform. The client/s agree to the IVY Terms of Use (https://www.ivy.co/tos/) Contract agreement including the terms for payment. The client/s will not hold BHdesign liable for any misconduct of either online platform associated with the company software.

(3) PAYMENT TERMS & CONDITIONS.

Client/s authorize BHdesign to process payment to charge the method of payment associated with client/s account. Client/s will use the client dashboard portal to issue payments of invoices. BHdesign accepts payments in the form of a credit card or wire transfer through the client dashboard portal using Houzz privacy and payment software. Client/s will be notified when payment of an invoice will be due. Invoices will be issued on project milestones at the discretion of BHdesign. Payment of an invoice is due at the time of the request. If the invoice is not paid in full at the time of payment, BHdesign will add a 10% increase of invoice charges. The history of payments are automatically tracked through the Houzz payment portal and protected by the privacy policy. In the event that a

client/s dispute/s charges and wants to take legal action, the client/s will be held responsible for any and all attorney or court fees as well as time of BHdesign’s services rendered with a 10% increase of the total invoice amount. The use of any legal manner to collect the amount owed to BHdesign is without prejudice.

(4) CANCELLATION POLICY.

In the event that the client/s want/s to cancel the services of BHdesign company, the client/s will pay BHdesign for the time spent on the agreed upon project as well as the time spent to design the plans to create a new proposal. Changing the original agreed upon plan, the client/s will be held responsible for the payment of BHdesign’s time that was spent on designing the original agreed upon plan as well as the new project design proposal costs including, but not limited to, a second consultation, cost of returning/cancelling products, contractor fee cancelation, deposit amount, etc. BHdesign reserves the right to discontinue services without notice.

(5) PRICE CHANGES.

BHdesign reserves the right to change prices. If BHdesign changes or updates prices, BHdesign will provide notice of the change by email and/or at BHdesign’s option at least 30 days before the change takes effect. To the extent the client/s continue to use BHdesign services after the price change becomes effective, such use constitutes the client/s agreement to pay the prices as amended. BHdesign may choose to temporarily change fees for promotional events or new services; these changes are effective when BHdesign announce the promotional event or new service and end earlier of the date identified or 30 days after the initial announcement

(6) TERMS OF SERVICE MODIFICATIONS.

BHdesign reserves the right to modify the terms of services. Refer to price changes with regards to price modifications.

(7) PAYMENT OF ARTWORK.

Client/s authorize BHdesign to process payment to charge the method of payment associated with client/s account. Client/s will use the client dashboard portal to issue payments of invoices. BHdesign accepts payments in the form of a credit card or wire transfer through the client dashboard portal using Houzz privacy and payment software. BHdesign accepts payment transfers to the ZELLE account of 561-212-3312. Prices will vary depending on artwork size and shipping costt.

(8) INTELLECTUAL PROPERTY RIGHTS.

Copyright and Trademark Policy of BHdesign includes website and blog content. BHdesign expects others to respect the intellectual property rights of content posted on BHdesign’s website (bhdesign002.com), including but limited too, other marketing platforms used by BHdesign (ie. instagram, facebook, emails, etc.), and regarding personal and business software data used by BHdesign. If you infringe copyrights or other intellectual property rights of BHdesign, violators will be reported in violation of Houzz policies or applicable laws. Houzz has adopted and implemented a Copyright and Trademark Policy. Legal advisors will be notified in processing the claimed infringement for fastest processing. Notices will be processed with regards to the Digital Millennium Copyright Act (the“DMCA”) (see http://www.loc.gov/copyright for details).
